The following
antitrust and trade regulation policies guide and govern the New
York State Telecommunications Association, Inc. (NYSTA) and its
directors, officers, employees, standing committees, subcommittees,
ad hoc committees, and any and all other representatives of this
Association.
1. From its
founding it has been the policy of the New York State Telecommunications
Association, Inc (NYSTA) to comply fully with the letter and spirit
of any and all laws and regulations relating to the Association
and its operations and activities. As a part of this long standing
commitment, it is and has been the policy of the association to
comply fully with the various federal and state laws and regulations
governing the area of antitrust and trade regulations.
2. In view of
the changing and evolving technological, legal and regulatory climate
relating to NYSTA and its members, it is appropriate to reaffirm
and restate our policies in the important area of antitrust and
trade regulation compliance. The directors, officers, employees,
standing committees, subcommittees, ad-hoc committees, special committees,
and any and all other representatives of NYSTA are obligated to
comply fully with any and all applicable laws and regulations relating
to antitrust and trade regulation. They are hereby instructed that
they are to take no action, or engage in any activity, that may
or will lessen competition between or among firms in the telecommunications
industry (whether or not members of NYSTA) or that may or will lessen
competition among such firms' suppliers - or customers. This policy
is intended to prohibit any action or activities by, or on behalf
of NYSTA, that may lessen competition, such as:
a. Fixing
or maintaining rates, prices, or terms and conditions of service
in an unlawful manner.
b. Allocating customers or territories among competitors or potential
competitors; or
c. Taking any other action that is or intended to be harmful to
competition.
3. Because of
the fact that the antitrust and trade regulation area is legally
complex (especially in view of the pervasive regulations that have
traditionally applied within the telecommunications industry) the
directors, officers, employees, standing committees, sub committees,
ad-hoc committees, and special committees, and any and all other
representatives of NYSTA are expected and instructed to seek promptly
the advice of counsel for the Association in the event that there
is any question as to whether any contemplated action, activity,
proposal, or other course of action may be in conflict with the
applicable laws and regulations.
